Cases of suspension of training activities of religious training establishments


A reader with email trantienxx@gmail.com sent an email to YouMe Law Firm asking: In what cases will religious training establishments be suspended from training activities, what is the maximum suspension period, and which agency has the authority to suspend the training activities of religious training establishments?
Jurist Nguyen Thi Thuy, YouMe Law Firm replied:
Clause 1, Clause 2, Clause 3, Clause 4, Article 16 of Circular No. 95/2023/ND-CP detailing a number of articles and measures to implement the Law on Belief and Religion stipulates the suspension of training activities of religious training establishments as follows:
1. Religious training establishments are suspended from training activities when they seriously violate one of the cases specified in Clause 4, Clause 5, Article 5 of the Law on Belief and Religion.
2. Based on the nature, level of violation and the ability to remedy the cause of suspension of the religious training facility, the decision-making authority shall determine the suspension period but not exceeding 24 months.

3. The decision to suspend the training activities of a religious training facility must be in writing, clearly stating the name of the religious organization that established the religious training facility, the name of the religious training facility, the representative, the headquarters of the religious training facility; the cause of suspension; the duration of suspension; the responsibility to remedy the cause of suspension.

4. The central state management agency for beliefs and religions has the authority to decide to suspend the training activities of a religious training facility.

Clause 4, Clause 5, Article 5 of the 2016 Law on Belief and Religion stipulates the following prohibited acts:
4. Belief and religious activities:
a) Violating national defense, security, national sovereignty, social order and safety, and the environment;
b) Violating social morality; violating the body, health, life, property; insulting the honor and dignity of others;
c) Obstructing the exercise of citizens' rights and obligations;
d) Dividing the nation; dividing religions; dividing people who follow beliefs and religions from people who do not follow beliefs and religions, and between people who follow different beliefs and religions.
5. Taking advantage of belief and religious activities for personal gain.
Thus, cases of suspension of training activities of religious training establishments are stipulated as above. The maximum suspension period is 24 months. The central state management agency for beliefs and religions has the authority to decide to suspend the training activities of religious training establishments according to the regulations cited above.
