Cases that are not eligible for the title "Cultural Family"?
A reader emailed trongnamxx@gmail.com and sent an email to YouMe Law Firm asking: According to the new regulations, which cases are not eligible for the title "Cultural Family"?
Jurist Nguyen Thu Thuy, YouMe Law Firm replied:
Article 6 of Decree No. 86/2023/ND-CP stipulates the framework of standards and procedures, procedures, and records for considering the title "cultural family", "cultural village, residential group", "typical commune, ward, town" (effective from January 30, 2024) stipulates the framework of standards for considering the titles as follows:
1. The framework of standards for considering the title "Cultural Family" is implemented according to the provisions in Appendix I attached to this Decree.
2. The framework of criteria for considering the award of the title “Cultural Village, Residential Group” shall be implemented according to the provisions in Appendix II attached to this Decree.
3. The framework of criteria for considering the award of the title “Typical Commune, Ward, Town” shall be implemented according to the provisions in Appendix III attached to this Decree.
4. Family members who violate one of the following cases shall not be considered for the title “Cultural Family”:
a) Being prosecuted for criminal liability;
b) Not fulfilling military service and tax obligations;
c) Being administratively sanctioned for: Child marriage, organizing child marriage; violating regulations on marriage, divorce and violating the monogamous marriage regime;
d) Being administratively sanctioned for: Violating regulations on public order; illegal gambling; preventing and combating social evils; preventing and combating fire, rescue and domestic violence.
5. Villages and residential groups that violate one of the following cases will not be considered for the title “Cultural Village and Residential Group”:
a) There are mass complaints and illegal complaints at higher levels;
b) There are religious activities that violate the law.
6. Communes, wards and towns that violate one of the following cases will not be considered for the title “Typical Commune, Ward and Town”:
a) Allowing complicated criminal, drug and social evil gathering places to occur; the rate of crimes, social evils and traffic accidents, fires and explosions is not controlled, increasing compared to the previous year, causing serious consequences;
b) Allowing citizens residing in the area to take advantage of the right to complain and denounce to gather in large numbers to cause disturbances to security and order, demonstrate, march and make illegal complaints.
c) Allowing anti-Party and anti-government activities to occur, undermining the great solidarity bloc.
Thus, cases that are not eligible for the title "Cultural Family" are stipulated as above.
