1. Regulations on granting a wholesale or wholesale agent license for tobacco products

The competent authority must carry out the following procedures:

Receive the dossier submitted by the units and individuals
Approve the dossier: Within 15 days from the date of receiving the complete and valid dossier, the Licensing Authority shall review and grant the Tobacco Product Business License. In case of refusal to grant the License, the Licensing Authority shall respond in writing stating the reasons for refusal;
Amendment and supplementation of dossier: In case the dossier is not valid, within 07 days from the date of receiving the dossier of the trader, the Licensing Authority shall issue a written request for the trader to supplement it;
The trader contacts the one-stop department to receive notice of amendments and supplements to the dossier as required;

2.1. Consulting on related legal issues

2.2. Instructing customers to prepare documents including:

Application for a license to wholesale (or wholesale agent) tobacco products;
A valid copy of the Business Registration Certificate, Tax Code Certificate;
Introduction letter from the tobacco product supplier, other wholesaler, clearly stating the expected business location;
Business plan, including:

  • Report on the business situation and results of the previous 3 years, accompanied by valid copies of sales contracts (or sales agents) with sales enterprises (if already in business), clearly stating: summary data on the type of tobacco products, purchase price, sale price, quantity and value of purchases and sales (total and divided by enterprise supplying tobacco products and by business location), taxes paid, profits...
  • Expected business results for the following year from the year the trader applies for a Wholesale Business License (or wholesale agent) of tobacco products; clearly stating: name and address of the enterprise that will sell to him/her, type of tobacco products, purchase price, sale price, quantity and value of purchases and sales (total and divided by enterprise supplying tobacco products and by business location), taxes to be paid, profits...;
  • Form of sales organization, method of distribution system management
  • List of technical facilities (warehouses, means of transport, etc.), human resources serving the business process of tobacco products;
  • List of traders that have been or will be in the distribution system, including: name of trader, head office address of trader, address of wholesale and retail stores of tobacco products (if any), tax code, valid copy of Tobacco product business license (if already in business), business location (expected assignment);

Documents proving the capacity of the enterprise, including:

  • Documents on the warehouse (or storage area) including: right to use the warehouse (owned, co-owned by the trader or leased for a minimum period of 01 year), location and capacity of the warehouse, technical factors to ensure the preservation of the quality of tobacco products during storage;
  • Documents on means of transport include: the right to use the means of transport (owned, co-owned by the trader or leased for a minimum period of 01 year), transport capacity, technical factors to ensure the preservation of the quality of tobacco products during transport;
  • Documents on financial capacity: confirmation of equity or guarantee from the selling enterprise or the bank where the trader opens an account... on financial assurance for the entire distribution system to operate normally;

2.3. Representing the customer to submit documents and receive results:

  • Submit documents to apply for a License to retail (or retail agent) tobacco products at the State Agency.
  • Receive results on behalf of the customer.

3. Number of documents

  • For Licenses issued by the Ministry of Industry and Trade: The License is made in multiple copies: 03 copies are kept at the Ministry, 01 copy is sent to the Market Management Department, 01 copy is sent to each Department of Industry and Trade named in the License (business location) and where the trader is headquartered, and 01 copy is sent to the trader who is granted;
  • For Licenses issued by the Department of Industry and Trade: The License is made in 05 copies: 02 copies are kept at the Department of Industry and Trade, 01 copy is sent to the Market Management Sub-Department under the Department of Industry and Trade where it is issued, 01 copy is sent to the Ministry of Industry and Trade, and 01 copy is sent to the trader who is granted;
