Army general's pension


Pursuant to Clause 1, Article 13 of the Law on Officers of the Vietnam People's Army 1999, amended by Clause 3, Article 1 of the Law on Amendments and Supplements to a Number of Articles of the Law on Officers of the Vietnam People's Army 2008 and Clause 2, Article 1 of the Law on Amendments and Supplements to a Number of Articles of the Law on Officers of the Vietnam People's Army 2014, the maximum age limit for officers serving in active service is implemented according to military rank. Accordingly, the highest age limit for military Generals is 60 years old for men and 55 years old for women. However, when the army has a need, Generals who have sufficient political and moral qualities, are good at expertise and profession, are in good health and volunteer can have their service age extended for no more than 5 years; special cases may be extended
Pursuant to Article 36 of the Law on Officers of the Vietnam People's Army 1999, the retirement conditions of officers when meeting the conditions according to the State's social insurance regulations and in cases where the retirement conditions according to the above regulations are not met, the army no longer needs to arrange officers, professional soldiers, defense civil servants or cannot change professions, if male officers have 25 years or more of service and female officers have 20 years or more of service in the army, they are eligible to retire.
Thus, according to the provisions of and Clause 1, Article 54 of the Law on Social Insurance 2014 (amended and supplemented by Clause 1, Article 169 of the Labor Code 2019) stipulate the retirement conditions of employees as follows:
Employees are eligible to retire when: Having paid social insurance (SI) for 20 years or more; Reaching the prescribed retirement age.
Accordingly, a General of the Army is eligible to retire when working under normal conditions with 20 years of social insurance contributions or more and reaching retirement age under normal working conditions. In addition, according to the provisions of Article 35 of the Law on Officers of the Vietnam People's Army 1999, amended by Clause 11, Article 1 of the Law on Amendments and Supplements to a Number of Articles of the Law on Officers of the Vietnam People's Army 2008, in cases where the retirement conditions are not met as prescribed but the Army no longer needs to arrange officers, professional soldiers, defense civil servants or cannot transfer to another profession, if a male General has 25 years or more of service in the Army and a female General has 20 years or more of service in the Army, they are eligible to retire.
